TERMS AND CONDITIONS OF SALE – CutOff Gallery
ARTICLE 1 – PURPOSE AND ACCEPTANCE OF THE TERMS AND CONDITIONS
These General Terms and Conditions of Sale (hereinafter “GTC”) govern the contractual relationship between CutOff Gallery (hereinafter “CutOff Gallery” or “the Seller”) and any buyer (hereinafter “the Customer”) in connection with the sale of fine art photographic prints (hereinafter “the Work”)
Any order placed for an art photograph featured on the websiteswww.cutoff.galleryand www.CutOffGallery.art implies prior, full, and unconditional acceptance of these GTC.
CutOff Gallery reserves the right to modify these GTC at any time and without notice. The applicable GTC are those in effect on the date of the order.                                
ARTICLE 2 – PERSONAL DATA
In accordance with the French Data Protection Act of January 6, 1978, and the General Data Protection Regulation (GDPR), the Customer has the right to access, correct, and delete data concerning them.
These rights may be exercised in writing at the address listed on the website or via the contact form.
The data collected is used exclusively for order tracking and communications, such as newsletters, from CutOff Gallery. It is not transferred or sold to third parties.
ARTICLE 3 – NATURE OF THE WORKS
The photographic prints offered by CutOff Gallery are original works of art as defined by applicable regulations.
Each print is:
  • Signed by the artist,
  • Numbered, with a maximum of thirty (30) copies in total, across all formats and media,
  • Accompanied by a certificate of authenticity.
    These works qualify for the tax status granted to works of art under Article 98 A of Annex 3 of the General Tax Code.
ARTICLE 4 – PRICES, TAXES, AND CUSTOMS DUTIES
Prices are listed in euros (€), inclusive of all taxes (TTC), excluding framing costs and shipping charges.
The value-added tax (VAT) applicable to works of art is 5.5% in accordance with current tax legislation.
For sales made outside the European Union, prices will be quoted exclusive of taxes. The Customer is considered the importer and remains responsible for paying any customs duties, local taxes, or import fees. These costs are not the responsibility of CutOff Gallery.
All orders, regardless of their origin and destination, must be paid in euros.
ARTICLE 5 – PRINT SIZES
The dimensions of the photographic prints listed on the website correspond to the total dimensions of the paper.
The User is advised that a white border may be added around the image for aesthetic purposes and to allow for the inclusion of the photographer’s visible signature. 
As a result, the actual size of the printed photograph may be slightly smaller than the stated size; however, this does not constitute a defect and does not give rise to a claim.
ARTICLE 6 – ORDER AND ACCEPTANCE
The ordering process is as follows:
  1. Contact the gallery by email.
  2. The Client will be provided with a quote for the selected artwork, including shipping costs. Framing costs may be included at the Client’s request. The quote is valid for 15 business days.
  3. Payment of a deposit equal to 50% of the total price of the artwork, including shipping costs and, if applicable, framing costs if requested by the Customer. This deposit must be paid within a maximum of 10 business days from the date of order confirmation. After this period, CutOff Gallery reserves the right to make the artwork available again. Upon receipt of the deposit, CutOff Gallery will email the Customer a receipt confirming payment and the commitment to produce the artwork.
  4. Order confirmation sent by CutOff Gallery to the Customer via email.
  5. Payment of the balance (50%) is due prior to shipment of the artwork. The artwork will be shipped within a maximum of 20 business days from the date CutOff Gallery receives full payment.
By placing an order, you agree to these Terms and Conditions.
Please note that since the photographs are displayed on the screen on the CutOff Gallery website, there may be minor variations in color or appearance compared to the actual artwork delivered. CutOff Gallery shall not be held liable for such differences. 
ARTICLE 7 – PAYMENT TERMS
Payment for orders must be made exclusively by bank transfer to the IBAN provided by CutOff Gallery.
Payment is due in two installments: a 50% deposit upon ordering, followed by the remaining 50% prior to shipment of the artwork.
No other form of payment will be accepted.
ARTICLE 8 – DELIVERY AND DELIVERY TIMES
The Customer is solely responsible for any failure or delay in delivery resulting from incomplete or incorrect entry of the delivery address information at the time of ordering.
Any costs incurred for reshipping the order due to an error in the information provided by the Customer at the time of ordering shall be borne exclusively by the Customer.
The artwork is carefully packaged by CutOff Gallery or a qualified partner in accordance with strict specifications, then entrusted to a specialized carrier (usually DHL Express, with insurance included). It is the Customer’s responsibility to inspect the artwork in the presence of the carrier. In the event of damage or breakage noted upon receipt, despite the precautions taken, the Customer is required to note reservations in writing on the delivery slip and to provide CutOff Gallery, within two business days, with a copy of the delivery slip indicating the reservations and photos of the artwork showing the damage. If the damage is confirmed by CutOff Gallery, it will cover the return shipping costs and arrange for a new shipment. No claims regarding damage will be considered if the conditions specified above are not fully met by the Customer.

  • North America, South America
  • Asia.
  • Africa
  • Australia
For any other destination, the Customer is asked to contact the gallery directly.
Delivery times average fifteen (15) business days from the date the artwork is shipped. They may vary depending on the geographic region, the carrier, or the selected shipping method.
The delivery times mentioned are provided for informational purposes only. Any delay in delivery shall not give rise to compensation, penalties, or cancellation of the order. However, if the order has not been shipped within a maximum of thirty (30) days after receipt of full payment, the Customer may cancel the order. In such a case, the amounts paid will be fully refunded, except in cases of force majeure.
ARTICLE 9 – WITHDRAWAL PERIOD
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the artwork to exercise their right of withdrawal.
To exercise the right of withdrawal, the Customer must notify CutOff Gallery by email of their decision to withdraw from this contract by means of an unambiguous statement (and must return the artwork within the aforementioned period. The return must be made at the Customer’s expense, in the original packaging, accompanied by the invoice and the certificate of authenticity. The artwork must be in perfect condition, with no damage.
The refund will be issued within twenty (20) business days of receipt and verification of the return.
Exception: Since prints mounted on rigid backing (such as Dibond® laminates or any other custom finishes) are personalized, the right of withdrawal does not apply.
Orders placed by professionals are not eligible for the right of withdrawal. 
ARTICLE 10 – LEGAL WARRANTY 
CutOff Gallery is liable for lack of conformity in accordance with Articles L 217-4 et seq. of the French Consumer Code and for latent defects within the meaning of Articles 1641 et seq. of the French Civil Code.
If the statutory warranty of conformity is invoked, the consumer customer:
  • has two years from the date of publication of the Work to take legal action,
  • may choose between repair or replacement of the Work, subject to the cost provisions set forth by law,
  • is not required to provide evidence of the existence of the lack of conformity during the 24 months following delivery of the Work.
Since photographs are original works of art, certain variations resulting from the printing or framing process should not be considered defects.
If the warranty against hidden defects is invoked, and the Customer is able to prove the existence of a hidden defect, the Customer may choose between rescission of the sale or a reduction in the purchase price.
After delivery, it is the Customer’s responsibility to ensure that the Work is properly stored and installed.
CutOff Gallery shall not be held liable for any resulting damages, including but not limited to:
  • prolonged exposure to direct sunlight,
  • due to a damp or unsuitable environment,
  • due to improper handling or mounting,
  • the use of acidic materials, unsuitable adhesives, or chemicals/abrasives on the print.
  • or any damage caused by improper storage.
The warranty does not cover damage resulting from use or storage that does not comply with general guidelines for the care of photographic prints.
In the event of a dispute for any reason whatsoever, CutOff Gallery’s liability is limited solely to direct property damage and shall not exceed the amount paid by the Customer for the artwork in question.
ARTICLE 11 – INTELLECTUAL PROPERTY
The purchase of a print does not confer any intellectual property rights in the work upon the Customer.
All rights of reproduction and public display remain the exclusive property of the author and/or CutOff Gallery.
Any unauthorized reproduction, public display, distribution, or public use constitutes an infringement and may be subject to legal action in accordance with Articles L.111-3, L.122-4, and L.335-2 of the Intellectual Property Code.
ARTICLE 12 – FORCE MAJEURE
CutOff Gallery is entitled to cancel any order and is, in particular, released from any obligation in the event of force majeure or failure by its own suppliers or contractors to meet deadlines, natural disasters, or acts of state, which, according to reasonable expectations, prevent either the production or the delivery of the Works. The following are specifically considered cases of force majeure: strikes, fires, floods, accidents involving equipment or tools, pandemics, transportation disruptions, or any other changes within or outside the company that prevent the normal and expected execution of sales. 
ARTICLE 13 – GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by French law.
In the event of a dispute, the Seller and the Customer agree to seek an amicable resolution before taking any legal action. 
Any dispute arising from their interpretation or enforcement shall fall within the exclusive jurisdiction of the competent French courts.
